About Medical Marijuana in Virginia

The Virginia General Assembly approved Governor Ralph Northam’s proposed amendments on April 7, 2021, making Virginia the first state in the South and the 17th in the US to legalize marijuana for adults. The new law became effective on July 1, 2021.

Virginia Marijuana Regulation law

Virginia’s HB 2312 and SB 1406 (which are nearly identical) will abolish marijuana illegality and replace it with a system that legalizes taxes and regulates marijuana for adults aged 21 and up. The bill also contains automatic closure of low-level past marijuana convictions, a social equity program to encourage involvement in the legal marijuana business by people who have been hurt by the war on marijuana, and a Marijuana Equity Reinvestment Fund that will receive 30% of tax revenue.

On February 27, 2021, the House and Senate passed HB 2312/SB 1406 in final voting. Governor Ralph Northam requested modifications, which were approved by the legislature on April 7.

Medical marijuana dispensaries in Virginia

Four dispensaries are open as of February 2021. In 2017, Virginia authorized a regulatory program that will allow five providers, one per Health Service Area (HSA), to cultivate, extract, administer, and deliver extraction-based medicinal marijuana products in the state. In Code, these approved providers are referred to as “pharmaceutical processors,” and they are vertically integrated marijuana businesses that handle everything from cultivation through distribution on one facility.

Marijuana possession limit

Adults aged 21 and up may possess up to one ounce of marijuana or the equivalent in marijuana products, and they may share that amount with other adults.
